The shocking truth: The Florida Constitution, (Article II, Section 3), separation of powers clause, explicitly bars lawyers, who are members of the Florida Bar and the judiciary branch, from running for public office outside that branch. That means they cannot become Mayors, Commissioners, School Board members, Legislators, etc. The U.S. Constitution contains a similar implicit clause. The legal profession ignores or refuses to enforce the law in Florida and elsewhere. Non enforcement of the law undermines the US and all State Constitutions. It results in enormous financial and emotional harm to the Nation in the areas of health, education, divorce, crime, cost of government, as well as virtually all other areas of the Nation's life. That result is precisely what Madison was trying to prevent when he wrote the US Constitution, on which all state constitutions are based. The harm will continue as long as lawyers are elected to public office. Since no single person can solve the problem, and the legal profession won't enforce the law in the courts, the only way left is to vote lawyers out of office at the ballot box. It's also the only way to stop the enormous dollar and emotional harm of their illegal control of government (which began in Florida in 1949). "I am running for Miami Beach Mayor on that platform, to obtain justice against an incumbent Lawyer-Mayor and a Lawyer-Commissioner. I am encouraging other non-lawyers to run for office on the same platform. We non-lawyers (99.7% of the population) must work together to rid our Nation of what is an effective lawyer monopoly of all three branches of government. This is the only way left to enforce the separation of power principle which James Madison made the cornerstone of our US Constitution." Floor Miami, Florida 33131 Re: Your registration as a candidate for the position of Mayor of Miami Beach, Florida. My name is Mike Calhoun and I am a qualified elector of the City of Miami Beach. I have been informed that you have registered as a candidate for Mayor of Miami Beach. My problem with that is that the Florida Constitution, Article I I, Section 3, specifically prohibits any person 'belonging to one branch of government' from exercising any power appertaining to either of the other two branches. As a lawyer, you are aware that the post of Mayor falls under the executive branch of Government. Thus the person who becomes Mayor will be exercising power in the executive branch. You are authorized to practice law in Florida. All lawyers authorized to practice in Florida must belong to, and be a member in good standing, of the Florida Bar. This is in accordance with the law as established by the Supreme Court of Florida's decision in Petition of Florida Bar Ass'n (40 SO 2d, 902), which created the so-called Unified or integrated Bar. That decision also merged the Bar with the Supreme Court and created in the Bar 'an arm of the Court'. It is therefore perfectly clear from a plain reading of the Constitution, that you and all practicing lawyers are members, and therefore belong to, the Florida Bar, which is an arm of the Florida Supreme Court, which is the judiciary branch of Government. That makes every practicing lawyer a person belonging to one branch of government (the judiciary), and therefore disqualified under the Florida Constitution from running for office in either of the other two branches. That means you are not qualified under the law to run. To disqualify you as a candidate I am required to file a complaint and then have you taken to court. I prefer to avoid that if possible. I am therefore requesting you examine your candidacy in the light of the information I have supplied here. If you agree with me, you need simply withdraw your name. If you do not, and have a valid reason that might refute my legal arguments, I would be grateful if you would share same with me by Tuesday April 27th., 1999.
