The Procedures in a Nutshell
- Immediately, after you get a ticket, send Discovery to the D.A. or City Attorney by Certified Mail, Return Receipt Requested.
- (At Arraignment, you can ask questions that could get dismissal, then refuse to Plead, because you don't understand the charges, but it doesn't always work there)
- After Arraignment, you can file a Trial by Declaration, which could include a Motion to Dismiss for Failure to Prosecute.
- If you lose the Trial by Declaration, you can then request a new trial, so you don't lose anything with Trial by Declaration.
- You can file a Motion to Dismiss for Failure to Prosecute before Trial
- If you go to trial, you should Prepare for Trial
- You should study what to say and not to say: Procedures and Strategies
- Normally, that's enough, and your Ticket should be dismissed, but if you get a bad judge, you may have to Appeal.

Understanding our Government and its Laws
First, you have to understand: "This is not a Democracy, but a Constitutional Republic".Our Founding Fathers called Democracy "Mobocracy", because the majority can do anything to the minority.
The Founding Fathers preferred a Republic, where we elect representatives to make our decisions for us,
but where a Constitution restricts those Representatives from making laws that restrict us.
Every Citizen was Sovereign, like the King, but no Citizen could harm another.
' Laws were mainly made to regulate Businesses in Commerce, not the Citizen not in Commerce.
Laws were formed to protect Citizens from harm by businesses and other Citizens, not to Regulate Citizens.
Laws were NOT to be created to regulate Citizens that weren't in Commerce, only to protect Citizens.
The Constitution does not allow our Representatives (our Public Servants) to Regulate us in any way.
"Drive" is a term in Commerce - I don't actually Drive (in commerce), I travel (for private purposes).
People have allowed their Representatives to force them to get Driver's Licenses, because
they felt it was safer to regulate everyone in a motor vehicle, but the Constitution didn't allow them to do that.
The California Motor Vehicle Code should only apply to commercial drivers, but when you get a non-Commercial "Driver's License", you are contracting to obey the (commercial) Vehicle Code. Because you agreed to get a Driver's License, you made a Contract with the State, so we aren't going to fight with this information.
